In Re Wawa, Inc. Data Security Litigation

 

We are pleased to announce that on July 30, 2021, the Court granted preliminary approval of the Consumer Track Plaintiffs’ Settlement with Wawa. The Settlement Administration website went live on August 30, 2021.

Those who made purchases at Wawa with their credit or debit cards from March 4, 2019 to December 19, 2019 are eligible to file a claim.  Submitting a claim is very straightforward using the link to the Settlement Administration website below and clicking on the orange button on the right-hand corner that says “File Claim.”  Claim forms that can be printed and mailed are also available on the website. The deadline to file claims is November 29, 2021.

The Settlement provides three alternative Tiers of relief to class members who submit a valid claim.  Eligible Tier 1 claimants (those who made a purchase during the relevant period using a credit or debit card and spent time monitoring their accounts) will receive a $5 gift card.  Eligible Tier 2 claimants (those who made a purchase during the relevant period using a credit or debit card; can provide reasonable proof of an actual or attempted fraudulent charge; and spent time monitoring their accounts as a result) will receive a $15 gift card.  Eligible Tier 3 claimants (those who made a purchase during the relevant period using a credit or debit card and can provide reasonable documentary proof of money they lost or spent out-of-pocket reasonably attributable to an actual or fraudulent charge) can receive cash reimbursement for their loss up to $500.

Also, under the settlement, Wawa has implemented and agreed to further implement significant data security enhancements collectively valued at no less than $35 million.

Weir & Partners LLP is pleased to announce that Brett A. Datto has been elected to the position of Administrative Managing Partner.  Walter Weir, Jr., long-time Managing Partner, will remain in his role.
 
Mr. Datto is a member of the firm’s Executive Committee and will continue to serve and support its many talented attorneys in his new role.  Mr. Datto has over 31 years of experience in complex commercial litigation and has been a partner with the firm since 1999.  Mr. Datto has represented clients in disputes involving multi-million dollar contract claims, construction, environmental, banking, insurance, real estate and employment issues, as well as business torts and state and federal criminal defense.
Mr. Datto is a member of the Pennsylvania and Philadelphia Trial Lawyers Association, the Justinian Society and is a former barrister in the Temple American Inn of Court, a group designed to improve the skills, professionalism and legal ethics of the bench and bar.  Presently, Mr. Datto serves as Judge Pro Tempore for both the Major Jury and Commerce Court programs in the Philadelphia Court of Common Pleas.
In addition to his many career accomplishments, Mr. Datto also serves as President of The Darren Daulton Foundation, an organization dedicated to providing financial assistance to those who suffer from brain cancer.  Recently, Mr. Datto was elected to the Board of The Residences of Two Liberty, a condominium community in Center City with over 100 residents.   

Mr. Datto previously served on the Board of Directors of the Blue White Scholarship Foundation at Villanova University, The Cheltenham Center for the Arts, and on the Board of Directors of Marley’s Mission, a charity that was once voted as “Best New Charity in America.”
